1. Terms of Licensing
1.1. This License Agreement describes terms of use of AbsolutePerl software product (software) by end user (user) as well as relations of the user and ZAO Mastak (developer) concerning the software.
1.2. This License Agreement is applied as soon as the end user receives the software using any possible media (including, but not limited to: downloading from Internet or other networks, receiving the software on any physically movable media source which contain the AbsolutePerl software and/or additional documents referring AbsolutePerl software).
1.3. This License Agreement covers usage of AbsolutePerl versions 0.1 - 0.9
2. End user registration and payments
2.1. AbsolutePerl is distributed as a Freeware product. That explicitly means that the user has the right to use AbsolutePerl versions v0.1 - v0.9 free of charge for unlimited period of time. No payments are taken or expected from user.
3. Developer rights and obligations
3.1. The Developer keeps all rights for the AbsolutePerl software binary code, source code, algorithms used and the entire documentation.
3.2. The Developer cannot be responsible for losses of any kind arising from using or misusing the software. No warranty of any kind is expressed or implied! The Developer does not guarantee that the software will comply with user's expectations or demands or textual descriptions found in the documents that accompany the software.
3.3. Software development process is controlled entirely by the Developer. All new versions are released basing on Developers decisions and timeline.
3.4. Developer guarantees that the AbsolutePerl software does not contain initially any 'Trojan horses', 'Virtual Spies', 'Bookmarks' and other fragments of code that does not comply with activities implemented by software. The software does not contain any portions of code that implements functionality other than the functionality described in documents accompanying the software.
4. End User rights and obligations
4.1. End Users may use the software according to AbsolutePerl documentation. Users are permitted to create backup copies of the software.
4.2. The End Users use the software at their own risk. The developer has no responsibility for such use and cannot not be claimed to be responsible for any aspects of use of the AbsolutePerl software!
4.3. All responsibility for usage of data generated as a result of AbsolutePerl work is held by the End User.
4.4. The user may apply for technical support and information regarding using the software to the Developer's technical support service and/or Developer's authorized representatives using the web site located at http://www.mastak.ru
4.5. The End User MAY NOT use the AbsolutePerl software for getting income of any kind by selling, lending, leasing, copying, duplicating, or using the software itself in any other way that can be referred to as 'commercial activity' without prior written consent with the Developer. This does not apply to software programs (data) generated by AbsolutePerl as a result of its work. The End User keeps all the rights for data generated by AbsolutePerl in process of its work. The End User MAY sell, lend, lease, distribute, patent, license, and use the resulted data in any other way referred to as 'commercial activity' without prior written consent with the Developer.
4.6. The End User MAY NOT modify program modules and documentation of AbsolutePerl software in any way (including, but not limited to: disassembling, decompilation, re-structuring, creation of own software products or components that use parts of AbsolutePerl code or interface elements specific to the software or algorithms of data processing) without prior written consent with the Developer.
5. Responsibilities
5.1. The End User solely holds all the responsibility for using the AbsolutePerl software.
5.2. The Developer does not hold any responsibility for the issues that may arise due to third parties relations with the End User.
5.3. The Developer is not responsible for damage of any kind as the result of use of modified program modules of AbsolutePerl software. Among such modifications are modules infected by computer viruses, modified by third parties without the Developer's permission etc. Obtaining the AbsolutePerl software from the sources other than provide by the Developer may result in acquiring the modified program modules by End Users. The Developer is not responsible for damage of any kind as a result of using such modules.
6. License Agreement termination
6.1. This License Agreement is terminated loses its legal power when the End User ceases to use AbsolutePerl software and deletes all copies of the software (either those that were received or created for backup purposes).
6.2. Violation of this License Agreement by the End User may (or may not) result in License Agreement termination. In such case the decision of License Agreement termination is taken solely by the Developer.
7. Final Statements
7.1. This License Agreement has the full legal power of official contract.
7.2. None of the words, phrases or blocks of text that make up this License Agreement can be treated as the statement of establishing the relations between the End User and the Developer that can be referred to as 'being an authorized agent of the Developer', 'partnership of any kind', 'co-operation', 'hiring and firing' or any other types of relations not described in the text of License Agreement explicitly. The relations mentioned above can be established upon signing an additional legal contract between the End User and the Developer.
7.3. Should any of the statements of this License Agreement be found illegal or ineffective by the official court all other statements of this License Agreement keep their power.
7.4. The Developer's ignorance of the fact of License Agreement violation by the End User does not deprive the Developer of its right to take legal action for the period of three years starting from the moment of License Agreement violation. The Developer keeps the right to take legal action against the End User in case of License Agreement violation as many times as the License Agreement is being violated.
7.5. This License Agreement is available in English only. Misunderstandings that may arise due to the End User's inability to understand English language does not grant any additional rights or remove any obligations from the End User.
